Event Marshal and Event Competitor Terms and Conditions.

The following terms and conditions apply to use of the Event Marshal App and associated services.

THIS SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS “AS IS” AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THE COPYRIGHT HOLDER OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

The Event Marshal App is not supplied as a navigation aid and must not be used as such.

Event Marshal is for information and entertainment purposes only. It is the users responsibility to provide adequate competitor tracking and marshalling services for an event outside and independent of the Event Marshal app and service. Dual Peaks or any other organisation, company or individual cannot provide any guarantee of service or suitability for use of the Event Marshal App or service.

Upgraded events must be completed within 11 months of the purchase of the upgrade.

Once closed upgraded events cannot be reopened.

You can, at any time, ask for your registered email to be deleted from Event Marshal and its database. Please email support@event-marshal.co.uk with 'DELETE' in the subject line from the email address you have registeted with. If you have participated in an event your data will be retained in the event to preserve database integrity, however your email address in the database will be replace with a generic address and your account deleted. This cannot be undone. You may re-register your email address, however a new account will be created and links to your previous data will not, and cannot be restored.

DualPeaks reserves the right to delete any event, at any stage, if we feel it violates or promotes practices or oganisatioons that breach our ethical standards or legal obligations.

We will endeavour to retain past and closed events in our database as long as possible. Due to the cost of data storage it may be necessary to delete past events or events that have been dormant for a significant time. For upgraded events a warning email will be sent to event creators prior to deletion.
